AN ACT
2        RELATING TO PUBLIC SAFETY; AMENDING CHAPTER 59, TITLE 18, IDAHO CODE, BY THE
3               ADDITION OF A NEW SECTION 18-5907, IDAHO CODE, TO REQUIRE RESERVED SEATING
4               FOR CONCERTS, TO DEFINE TERMS AND TO PROVIDE PENALTIES.

5        Be It Enacted by the Legislature of the State of Idaho:

6               SECTION, 1. That Chapter 59,Title 18, Idaho Code, be, and the same is
7        hereby amended by the addition thereto of a NEW SECTION, to be known and des-
8        ignated as Section 18-5907, Idaho Code, and to read as follows:

9               18-5907. CONCERTS -- RESERVED SEATING REQUIRED. Admissions to all indoor
10       places of assembly seating over two thousand (2,000) persons wherein concerts
11       are to be performed shall be by reserved seating only."Concert" means a musi-
12       cal performance of which the primary component is a presentation by persons
13       singing or playing musical instruments, that is intended by its sponsors
14       mainly, but not necessarily exclusively, for the listening enjoyment of the
15       audience, and that is held in a facility. A "concert" does not include any
16       performance in which music is a part of the presentation and the primary com-
17       ponent of which is acting, dancing, a motion picture, a demonstration of
18       skills or talent other than singing or playing an instrument, an athletic
19       event, an exhibition, or a speech. Reserved seating means that tickets are
20       sold with a specific seat number which corresponds to a specific ticket. This
21       section shall not apply to: (1) events sponsored by schools; or (2) events
22       sponsored by bona fide religious organizations. No proprietor of any place of
23       indoor assembly seating over two thousand (2,000) persons, and no managers or
24       other person or persons in charge thereof shall sell or allow to be sold
25       nonreserved seating for a concert performance. Each performance for which
26       nonreserved seating is sold shall constitute a single offense. A violation of
27       the provisions of this section shall constitute a misdemeanor and shall be
28       punishable by imprisonment in a county jail not exceeding six (6) months, or
29       by a fine not exceeding one thousand dollars ($1,000), or by both such fine
30       and imprisonment.
